Introduction to Battery Waste Management Rule 2022

To ensure the responsible management of used batteries, the Ministry of Environment, Forest and Climate Change has released the “Battery Waste Management Rule, 2022” dated 22nd Aug 2022. The Producer as per the released rule is responsible to submit the data of waste batteries to CPCB (Central Pollution Control Board) with other requisite documentation in order to acquire EPR (Extended Producer Responsibility).

Key highlights:

i)These rules apply to Producer, dealer, consumer, entities involved in collection, segregation, transportation, re-furbishment and recycling of Waste Battery.

  1. All types of batteries regardless of chemistry, shape, volume, weight, material composition and use are covered under this rule.
  2. These rules do not apply to Battery used in equipment connected with the protection of the essential security interests including arms, ammunitions, war material and those intended specifically for military purposes.

Who will apply as Producer?

An entity who is engaged in the manufacturing, sale and import of batteries including refurbished batteries and equipment containing batteries. Producer has to be an Indian entity to apply for EPR.

Application process for registration to CPCB:

Currently, the online centralized portal is under development stage to file an application. Hence as per the attached gazette notification, producers are allow get the provisional registration which will be valid for 6 months. However, producers need to apply online further once portal will come into action to complete the further process in portal in order to get the EPR.
